These Terms of Service ("Terms") govern your access to and use of AI Aware Certified (the "Service"), operated by AI Aware Certified ("we", "us", or "our"). By creating an account or using the Service, you agree to these Terms.
1. The Service
AI Aware Certified is a software platform that helps organizations document their preparation for the EU Artificial Intelligence Act. The Service includes guided assessments, document generation, evidence storage, and a self-attestation certificate.
Not legal advice
The Service is software, not a law firm. Nothing produced by the Service — including assessments, generated documents, and certificates — constitutes legal advice, a regulatory opinion, or a notified-body conformity assessment. Certificates issued through the Service are self-attestations only. For legal questions, consult qualified counsel in your jurisdiction.
2. Accounts
- You must be at least 18 years old and authorized to bind your organization.
- You are responsible for keeping your credentials secure and for all activity on your account.
- You must provide accurate information and keep it current.
3. Acceptable use
You agree not to:
- Use the Service to violate any law or third-party right.
- Upload malicious code, attempt to breach the Service, or scrape it at scale.
- Resell or sublicense the Service without our written consent.
- Submit content you do not have the right to submit.
4. Subscriptions and billing
Paid plans are billed in advance on a recurring basis. Fees are non-refundable except where required by law. You may cancel at any time; cancellation takes effect at the end of the current billing period. Plan limits, including the number of AI systems you may track and documents you may generate, are described on our pricing page.
5. Your content
You retain ownership of all content you upload. You grant us a limited license to host, process, and display your content solely to provide the Service. You are responsible for ensuring your content complies with applicable law.
6. AI-generated content
The Service uses large language models to draft documents. Output may contain errors or omissions and must be reviewed by a qualified person before being relied upon. You are responsible for the final content of any document you export or share.
7. Intellectual property
We retain all rights in the Service, including software, templates, and branding. You receive a limited, non-exclusive, non-transferable right to use the Service in accordance with these Terms.
8. Termination
We may suspend or terminate your account for material breach of these Terms or for non-payment. On termination, your right to use the Service ends; you may export your data for 30 days following termination.
9. Warranty disclaimer
The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or sufficient to achieve regulatory compliance.
10. Limitation of liability
To the maximum extent permitted by law, our aggregate liability arising out of or relating to the Service will not exceed the greater of (a) the amount you paid us in the 12 months before the claim arose or (b) US$100. We will not be liable for indirect, incidental, consequential, special, or punitive damages, or for lost profits, revenue, or data.
11. Indemnity
You will indemnify us against claims arising from your content, your use of the Service in violation of these Terms, or your violation of law.
12. Changes to the Terms
We may update these Terms from time to time. Material changes will be notified by email or in-product notice at least 14 days before they take effect.
13. Governing law
These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-laws principles. Exclusive jurisdiction lies in the courts located in Delaware.
